XL Overhead Construction, Inc. has agreed to pay $199,273 in back overtime wages to 92 employees following an investigation conducted by the U.S. Department of Labor's wage and hour division.
According to the federal agency, the company currently operates as XL Cable in Orangeville.
"This investigation reflects the department's commitment to protecting the overtime rights of workers and ensuring that workers receive the full wages they have earned," commented Dean Campbell, wage and hour division district director in Salt Lake City. "In this case, we recovered $199,273 in back wages for these workers."
The employer purportedly violated the Fair Labor Standards Act (FLSA) by failing to properly pay overtime to employees receiving a piece rate.
Additionally, the firm reportedly did not include production based bonuses in the regular rate of pay when computing overtime.
"Employers must make sure they properly calculate the employees' regular rate of pay or overtime premiums will not be computed accurately," said Campbell.
The firm agreed to future compliance and payment of all back wages.
Enforced by the wage and hour division, the FLSA requires that employers pay covered workers at least the federal minimum wage for all hours worked and time and one-half the regular rate of pay for hours worked more than 40 in a single work week.
Companies must maintain adequate and accurate records of employees' wages, hours and other conditions of employment.
