Notice Of Trustee's Sale
The following described property will be sold at public auction to the
highest bidder, payable in lawful money of the United States at the
time of the sale, "at the East Main Entrance, Courts Complex, Carbon
County Courthouse, 149 East 100 South, Price, Utah", on January 18,
2011, at 1:00 PM, of said day, for the purpose of foreclosing a trust
deed dated August 26, 2006 and executed by CARL W WEBER, AND DEBRA A.
WEBER, HUSBAND AND WIFE, AS JOINT TENANTS, as Trustor(s) in favor of
MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC. as Beneficiary,
covering the following real property located in Carbon County:
BEGINNING at a point 847 feet North of the Southwest Corner of the
Northeast Quarter of the Southwest Quarter of Section 5, Township 15
South, Range 11 East, Salt Lake Base and Meridian, and running thence
East 200 feet; thence South 230 feet; thence East 189.4 feet; thence
South 196.25 feet; thence West 389.4 feet; thence North 426.25 feet to
the point of beginning.
A parcel of land located in the Northwest Quarter of the Southwest
Quarter of Section 5, Township 15 South, Range 11 East, Salt Lake Base
and Meridian, being further described as follows with a bearing of
North 0Â°08'59" West between the Southwest Corner and the West
Quarter Corner of said Section 5 used as the basis of bearing, which
is the Utah State Plane coordinate system (central zone) as
established by the Carbon County Surveyors office:
BEGINNING at a point which is located North 00Â°13'34 West along the
Forty Acre Line 420.75 feet from the Southwest Corner of the Northeast
Quarter of the Southwest Quarter of said Section 5; and running thence
North 00Â°13'34" West along the Forty Acre Line 311.52 feet; thence
South 89Â°15'50" West 47.29 feet; thence South 00Â°13'34" East
311.52 feet; thence North 89Â°15'50" East 47.29 feet to the point of
EXEPTING from said Parcel 2 that portion previously conveyed to Carbon
County for road purposes.
Situate in Carbon County, State of Utah.
Together with all the improvements now or hereafter erected on the
property, and all easements, appurtenances, and fixtures now or
hereafter a part of the property.

The address of the property is purported to be 350 NORTH 950 EAST,
WELLINGTON, UT 84542. The undersigned disclaims liability for any
error in the address. The current Beneficiary of the trust deed is THE
BANK OF NEW YORK MELLON FKA THE BANK OF NEW YORK, AS TRUSTEE FOR THE
CERTIFICATEHOLDERS CWABS, INC., ASSET-BACKED CERTIFICATES,SERIES
2006-18, and the record owners of the property as of the recording of
the notice of default is reported to be CARL W WEBER, AND DEBRA A.
WEBER, HUSBAND AND WIFE, AS JOINT TENANTS.
Bidders must be prepared to tender to the trustee, RECONTRUST
COMPANY, N.A., $5,000.00 at the sale and the balance of the purchase
price by 12:00 noon the day following the sale and deliverable to:
Matheson, Mortensen, et al., 648 East First South, Salt Lake City, UT
84102. Both payments must be in the form of a cashier's check or
money order and made payable to RECONTRUST COMPANY, N.A., cash and
Bank "Official Checks" are not acceptable. A trustee's deed will be
made available to the successful bidder within three business days
following receipt of the bid amount. The sale is made without any
warranty whatsoever, including but not limited to any warranty as to
title, liens, possession, taxes, encumbrances, or condition of the
property. The sale is subject to a workout reinstatement, payoff,
sale cancellation or postponement, incorrect bidding instructions,
bankruptcy, or any other circumstance of which the trustee is unaware.
In the event any of the foregoing apply, the sale will be void and
the successful bidder's funds will be returned without any liability
to the trustee or beneficiary for interest or any other damages.
