NOTICE OF TRUSTEE'S SALE
The following described property will be sold at public auction to
the highest bidder, payable in lawful money of the United States at
the time of sale and in the manner set forth below, such public
auction to be held at the main front entrance of the Carbon County
Courthouse, 149 East 100 South, Price, Utah 84501 on JulyÂ 23, 2013
at the hour of 11:00 a.m. for the purpose of foreclosing the Deed of
Trust (the "Deed of Trust") dated MayÂ 3, 2006 and executed by DAVID
KNOTT, as Trustor and granted and conveyed to WASHINGTON FEDERAL,
formerly Washington Federal Savings, as Beneficiary and Trustee. The
Deed of Trust was recorded on MayÂ 3, 2006 as Entry No.Â 117024 in
BookÂ 617 beginning at PageÂ 615 in the Official Records of the
County Recorder of Carbon County, Utah. W.Â Jeffery Fillmore has
been appointed Successor Trustee of the Deed of Trust.
The property subject to the Deed of Trust is situated in Carbon
County, Utah and is more particularly described as follows (the
BEGINNING AT A POINT 29 FEET WEST AND 1000 FEET SOUTH OF THE NORTHEAST
CORNER OF SECTION 32, TOWNSHIP 14 SOUTH, RANGE 10 EAST, SALT LAKE BASE
AND MERIDIAN, AND RUNNING THENCE SOUTH 96 FEET; THENCE WEST 390 FEET;
THENCE NORTH 96 FEET; THENCE EAST 390 FEET TO THE POINT OF BEGINNING.
EXCEPTING THEREFROM ALL OIL, GAS AND MINERALS AND MINERAL RIGHTS IN
AND TO SAID LANDS.
TOGETHER WITH all improvements, easements, rights, appurtenances,
rents, royalties, mineral, oil and gas rights and profits, water
rights and stock and all fixtures.
For information purposes only the Property has a reputed address of
2198 South Highway 10, Price, Utah 84501 and tax parcel ID No.
02-1703-0000. The current beneficiary of the Deed of Trust is
Washington Federal and the record owner of the Property as of the
recording of the Notice of Default and Election to Sell is David E.
The Trustee's sale will be made without covenant or warranty, express
or implied, regarding title, possession or encumbrances. The Trustee
disclaims any responsibility for any error in the legal description of
the Property. The sale is also subject to workout, reinstatement,
payoff, sale cancellation or postponement, incorrect bidding
instruction, bankruptcy, or any other circumstance of which the
Trustee is unaware. If any of the foregoing applies, the sale will be
void and the successful bidder's funds will be returned without any
liability of the Trustee or Washington Federal for interest or any
Bidders must tender a $10,000 deposit to the Successor Trustee at the
time of bidding at the foreclosure sale and the balance of the
purchase price must be paid by 12:00 noon the business day following
the sale unless other arrangements are made in writing with the
Trustee. The bid deposit must be in the form of a cashier's check or
an official check issued by a bank or credit union and payable to
Washington Federal. The balance of the purchase price must be in the
form of a wire transfer, cashier's check or official check issued by a
bank or credit union and payable to Washington Federal. Cash payments
are not accepted. A trustee's deed will be delivered to the
successful bidder within three business days after receipt of
collected funds in the amount bid.
The purpose of this notice is to collect a debt and any information
obtained may be used for that purpose.
