NOTICE OF PERMIT MODIFICATION APPROVAL
The East Carbon Development Corporation (ECDC) submitted a request to
the Division of Solid and Hazardous Waste to modify its existing solid
waste permit to build a new solid waste landfill cell for disposal of
wastes that contain PCBs in concentrations greater than 50 ppm. ECDC
operates a commercial solid waste landfill located two miles west of
the City of East Carbon, Utah.
PCB waste is regulated as a special category of nonhazardous waste.
Receipt and management of PCB waste requires both a modification of
ECDC's existing solid waste permit and approval from the US
Environmental Protection Agency. The Division of Solid and Hazardous
Waste reviewed ECDC's request and supporting documentation and
prepared a draft modification. A notice for public comment on the
draft permit modification was published in the Salt Lake Tribune,
Deseret News and The Sun Advocate on December 15, 2011. A public
hearing was held on December 21, 2011. Public comments were received
during the public hearing and by both mail and email. ECDC has
submitted additional documentation in response to comments received.
These documents have been incorporated into the final permit.
The modification to ECDC's permit was approved on June 13, 2013. A

This modified permit is effective upon issuance. Anyone wishing to
challenge the modified permit must do so in the manner and within the
time period prescribed by Utah Administrative Code R305-7-203. Failure
to contest the modified permit within the period provided in
R305-7-203(5) constitutes a waiver of any right of administrative
contest, reconsideration, review, or judicial appeal in accordance
with Utah Administrative Code R3 05 -7-203(6).
