LEGAL NOTICE OF PROPOSED ACTION Nyland Access Road USDA Forest Service Manti-La Sal National Forest

	The Manti-La Sal National Forest, Moab Ranger District is completing
a Decision Memo for Nyland Access Road and would like to consider your
comments or concerns before making a decision. The proposal is to
authorize Nyland to occupy National Forest Service lands in order to
construct a private access road approximately 190 feet long by 16 feet
wide beginning at Forest Road 0129 and ending at the Forest Boundary. 
The road would be located approximately 1 mile west of Dark Canyon
Lake in the La Sal Mountains in Section 18, T27S, R25E, SLB&M.  A
locked gate would be installed at the junction with the Forest System
road to allow access by authorized users only.  An environmental
review is currently being conducted.  Experts, specializing in natural
resource areas such as vegetation, wildlife, cultural resources, range
and other natural resources, will submit a report analyzing effects to
their area of expertise.  As a result, design features will likely be
added to the project to minimize the environmental impacts.  For maps

	In light of a recent court ruling (Sequoia ForestKeeper v. Tidwell,
11-cv-00679-LJO-DLB (E.D. Cal.)), the Forest Service will provide
public notice, comment, and opportunity for administrative appeal for
projects and activities documented with a "Decision Memo" (36 CFR
220.6(e)) until new instructions are issued by the Washington Office,
or the Agency issues regulations addressing the Court's ruling. In
addition, the Forest Service will prepare Decision Memos and offer
notice, comment and appeal opportunities for timber sales and proposed
approvals of oil or gas exploration and development activities that
rely upon Section 390 of the Energy Policy Act of 2005. Only those who
provide comment or express interest in this proposal during this
comment period will be eligible to appeal the decision pursuant to 36
CFR part 215 regulations.

	Only those who submit timely comments during this comment period will
be accepted as potential appellants.  Comments can be either oral or
written in response to this project. Each individual or representative
from each organization, submitting comments must either sign the
comments or otherwise verify identity in order to attain appeal
eligibility. Comments received, including names and addresses of those
who comment, will be considered part of the public record for this
project and will be available for public inspection. Comments should
include the information required pursuant to 36 CFR 215.6(a)(3), as
published in the Federal Register on June 4, 2003.

ends 30 days following the date of publication of this legal notice in
the Sun Advocate.
