LEGAL NOTICE DECISION NOTICE/FINDING OF NO SIGNIFICANT IMPACT Manti-La Sal National Forest Ferron-Price Ranger District, Carbon County, Utah

	The Manti-La Sal National Forest and Utah Department of Oil, Gas, and
Mining-Abandoned Mine Reclamation Program (DOGM-AMRP) jointly
conducted an Environmental Analysis (EA) of the Pondtown Creek
Abandoned Mine Reclamation Project.  The project area is located
approximately 2.7 miles west of Scofield Reservoir and 1.5 miles west
of the Forest boundary on FR009 in Carbon County, Utah, T12S R6E,
Section 2, SLBM.  This project would provide a comprehensive
reclamation strategy by removing coal waste from the stream banks,
containing it in an onsite disposal area in a less environmentally
sensitive location, and enhancing vegetative cover on the stream
banks. The reclamation strategy would also protect water quality from
potential coal sedimentation and stream bank failure.  Funding for the
reclamation project is provided through a grant from the Office of
Surface Mining Reclamation and Enforcement (OSM) to DOGM-AMRP.  

	Darren Olsen, District Ranger, Ferron-Price Ranger District, Manti-La
Sal National Forest, has decided to approve the site reclamation.  The
Decision Notice and Finding of No Significant Impact document this
decision.  The Selected Alternative is Alternative 3 (The Modified
Proposed Action).  It is consistent with Forest Plan management
requirements for the Manti-La Sal National Forest with regard to
management of abandoned mine sites and will maintain suitable riparian
and aquatic habitat for various plant and animal species. It will also
allow DOGM-AMRP to comply with their plan by reclaiming the site and
utilize funding provided by OSM under the authority of the Surface
Mining Control and Reclamation Act (SMCRA) to mitigate abandoned
mine-related safety hazards and environmental degradation.

	This decision is not subject to appeal pursuant to Forest Service
regulations at 36 CFR § 215.12(e)(1). Only individuals or
organizations who submitted comments or otherwise expressed interest
in the project during the comment period may appeal. The Forest
received no comments in response to the legal notice of proposed
action for this project.  

	The Decision Notice, Finding of No Significant Impact, and EA are
available for review at the Forest Service office in Price, Utah.  Any
