NOTICE OF TRUSTEE'S SALE
The following described property will be sold at public auction to
the highest bidder, payable in lawful money of the United States, at
the front entrance of the Seventh District Courthouse, Carbon County,
120 East Main, Price, Utah 84501, on Thursday, April 20, 2012 at 11:30
a.m. of said day for the purpose of foreclosing the Deed of Trust
dated June 6, 2002, executed by WESTON HANSEN and SHARRON HANSEN,
collectively, as Trustor, in favor of FAR WEST BANK, as Beneficiary,
and FAR WEST BANK, as Trustee (the "Trust Deed") and filed for
recording on June 6, 2002 as Entry No. 092070 of Official Records of
Carbon County, Utah.
The Substitution of Trustee appointing Nathan S. Dorius as successor
trustee was filed for recording with the Carbon County Recorder on
December 13, 2011 as Entry No. 813205. The Notice of Default was filed
for recording with the Carbon County Recorder on December 13, 2011 as
Entry No. 813206.
Trustee will sell at public auction to the highest bidder without
covenant or warranty as to title, express or implied, possession,
condition or encumbrances, including fees, charges, and expenses of
the Trustee and of the trusts created by said Trust Deed, to pay the
remaining sums owing under the note secured by said Trust Deed,
including delinquent property taxes, the real property situated in
Carbon County, Utah, described in as below:
Beginning at the South Quarter Corner of Section 8, Township 15 South,
Range 11 East Salt Lake Base and Meridian (Bearing base Â¼ Section
line N 0Â°31'17" West); thence North 0Â°31'17" West 902.93 feet to
a point on the Northerly limits of Ridge Road (said limits is 50 feet
from the Center Line of Ridge Road), which point is the true point of
beginning; thence along the North road limits, North 34Â°55'13" East
577.74 feet; along the arc of a 1050 feet radius curve 525.19 feet
(the long chord bears North 49Â°08'43" East 519.73 feet); thence
North 26Â°31'35" West 55 feet to a point which is 105 feet from the
Center of Ridge Road; thence North 63 deg. 17'08" East 458.13 feet to
a point on the Westerly line of the Southern Pacific Railroad; thence
along said line the arc of a 3080 foot radius curve 1255.50 feet (long
chord bears North 64Â°22'05" West 1246.04 feet); thence South along
the Quarter line South 0Â°31'56" East 1609.95 feet, more or less, to
the point of beginning.
LESS THE following described land conveyed to Emery Industrial
Commencing at the South Quarter corner of Section 8, Township 15
South, Range 11 East, Salt Lake Base and Meridian (bearing base, Â¼
Section line North 0Â°31'17" West); thence North 0Â°31'17" West
902.93 feet to a point on the Northerly limits of Ridge Road, (Said
limits is 50 feet from the centerline of Ridge Road, which is the true
place of beginning); thence along the North road limits, North
34Â°55'13" East 577.74 feet to a point of curve; thence along the
arc of 1050.0 foot radius curve 274.93 feet (the long chord bears
North 42Â°15'38" East 272.07 feet); thence North 67Â°22'44" West
565.29 feet to a point on the Quarter line; thence along the Quarter
line South 0Â°31'17" East 892.55 feet to the point of beginning.
The sale is subject to a bankruptcy filing, a payoff, a reinstatement
or any other condition of which the Trustee is not aware that would
cause the cancellation of the sale. If any such condition exists, the
sale shall be void, the successful bidder's funds returned and the
Trustee and current beneficiary shall not be liable to the successful
bidder for any damage.
The address of the property is purported to be 5577 East Wash Plant
Road, Wellington, UT 84542. The undersigned disclaims liability for
any error in the address. The current beneficiary of the Trust Deed is
Far West Bank. The purported owner of the property as of the recording
of the notice of default is Quality Building Stone.
Bidders must be prepared to tender to the trustee a $5,000.00
cashier's check at the sale and a cashier's check for the balance of
the purchase price within 24 hours after the sale.
